JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 409, 467, 468, 471, 34 of the Indian Penal Code.
The prosecution case is that the petitioner being a liquor licensee did not deposit the license fee for the period 201011 and 2011-12 amounting to Rs. 4,62,340/-. It is submitted by the learned counsel for the petitioner that the petitioner has already deposited the above mentioned amount.
Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court
Patna High Court Cr.Misc. No.18291 of 2016 (2) dt.28-04-2016 2/2 below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Dumra P.S. Case No. 75 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner shall be confirmed by the court below on verification of the fact that petitioner has already deposited the due licence fee amount.
