JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-08-2017 The petitioner is apprehending his arrest in connection with Basnahi P.S. Case No. 84 of 2016, registered for offences punishable under Sections 147, 148, 149, 341, 323, 325, 379, 504 and 506 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is of assaulting the informant causing injury to him and also allegation of firing, however, the same did not hit anyone.
It has been submitted on behalf of the petitioner that out and out false and concocted case has been lodged by the petitioner. Further there is case and counter case between the parties and the case lodged by the petitioner is prior to the case lodged by the informant and only to save his skin from that case the informant has filed this case. It has also been submitted that
Patna High Court Cr.Misc. No.36394 of 2017 (2) dt.10-08-2017 petitioner has also received injuries in his hand. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, nature of offence, I am not inclined to grant the privilege of anticipatory bail to the petitioner, his application is accordingly rejected.
Let petitioner surrender before the court below and make prayer for regular bail and if any such application is filed, the court below after considering the submission of learned counsel for the petitioner that no firing was made and also there is case and counter case and petitioner has also received injuries, shall pass an appropriate order, if possible on same day, without being prejudiced by the order of this Court.
With the above observation, this application is disposed of.
