ANJANA MISHRA ORAL ORDER 04-07-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Barhat P.S. Case No.8 of 2016 for allegedly having committed the offence under Sections 341, 342, 323, 325, 307, 379 and 504/34 of the Indian Penal Code, pending in the court of Sri Sanjay Kumar, Judicial Magistrate, 1st Class, Jamui.

Case diary in the present case was called for, which has since been received.

After hearing the learned counsel for the petitioners and on perusal of the case diary, it appears that the prosecution

No.18740 of 2016 (3) dt.04-07-2016 2/2 story as detailed by the informant has been supported by other independent witnesses and that the injury report also corroborates the prosecution version. As such, I am not inclined to grant anticipatory bail to the petitioners. It is, accordingly, rejected.

However, if the petitioners surrender within a period of six weeks in connection with the present case and pray for regular bail in the court below, their case may be considered on its own merits without being prejudiced by the present order. (Anjana Mishra, J) PNM U T
