JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Bidupur P. S. Case No. 240 of 2019, disclosing offences under Sections 341, 323, 308, 498A of IPC. Allegation against the petitioners, who happens to be the father-in-law and mother-in-law of the informant of assault to the informant along with other co-accused persons and further in spite of compromise reached between the parties, the husband of the informant assaulted her and against these petitioners also there is allegation of assault. Submission of the learned counsel for the petitioners is that no specific allegation has been attributed against them and the husband of the informant has already been granted regular bail by the learned court below.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P. S. Case No. 240 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they have to co-operate in the investigation.
