JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Petitioner is languishing in custody since 04.05.2015 in a case registered for the offences punishable under Sections 376/34 of the Indian Penal Code and Section 4 of the Protection of Children From Sexual Offences Act. It is alleged that co-accused Baiju Baitha ravished the informant aged seven years. It is further alleged that when Baiju Baitha was being assaulted by the villagers then petitioner and others got Baiju Baitha released from the custody of the villagers.

It is submitted by learned counsel for the petitioner that thrust of accusation is against Baiju Baitha. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.26616 of 2015 (2) dt.31-07-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Muzaffarpur in connection with Musahri P.S. Case No. 63 of 2015.
