Petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that petitioner is 78 years old and the maintenance case and the earlier complaint case being Complaint Case No. 77C of 1998 have been compromised by the complainant. Moreover the complainant is still residing with petitioner and petitioner is ready to keep the complainant with dignity and honour. A statement to that effect has been made in para 16 of

Patna High Court Cr.Misc. No.34777 of 2015 (2) dt.17-08-2015 2/2 the petition.

Considering the present stand and advance age of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria in connection with Complaint Case No. 3785C of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
