ANJANA MISHRA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends her arrest in connection with a case registered for the offences punishable under Sections 467/468/471/420/120B of the Indian Penal Code. Learned counsel for the petitioner submits that evidently the present dispute has arisen out of a sale and purchase and there is dispute between the daughter-in-law and mother-in-law and consequently, the petitioner who had been managing the properties has been roped into the present case.
Learned counsel for the petitioner submits that if at all there was any sale or any Will before the Registration Office, it would have been appropriate for the informant to seek proper remedy
Patna High Court Cr.Misc. No.31686 of 2015 (2) dt.13-08-2015 P2/2 before the appropriate court having civil jurisdiction. Considering the aforementioned submissions and the peculiar nature of the case and also the fact that the petitioner has no criminal antecedent, let the petitioner Saraswati Devi, in the event of her arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Darauli P.S. Case No. 198 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
