2. The petitioners seek regular bail in connection with Chandan (Anandpur) P.S. Case No. 112 of 2023 registered for the offence under Sections 341, 323, 325, 308, 504, 506/34 of the Indian Penal Code.

3. As As per prosecution case, the petitioners are alleged to have assaulted the informant and his parents by means of axe due to which informant sustained injuries. The alleged occurrence took place in the background of previous dispute.

4. Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.63651 of 2023(2) dt.10-10-2023 2/2 petitioners are innocent and have committed no offence. They have falsely been implicated in this case due dirty village politics. It is also submitted that the injury sustained by informant is simple in nature which is evident from Annxure-P2. There is also case and counter case between the parties. The petitioners have got no criminal antecedent as stated in para-3 of the bail petition and languishing in judicial custody since 14.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Chandan (Anandpur) P.S. Case No. 112 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka.
