The petitioner apprehends his arrest in connection with Barahara (Krishna Gadh O.P.) P.S.Case No. 78 of 2017 for the offence registered under Sections 147, 148, 149, 323, 341 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The allegation, in brief, is that due to quarrel in between the children of both sides, this occurrence took place and allegation is that Upendra Yadav opened fire which hit no one and specific allegation against the petitioner is that he gave a specific rod blow over the head of the informant.
It is submitted that on trivial issue, this occurrence took place between both sides and there is a case and counter case and in course of scuffle petitioner fell down and sustained injury
Patna High Court Cr.Misc. No.39315 of 2017 (3) dt.17-10-2017 2/2 which is simple in nature and this petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Munna Yadav, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Barahara (Krishna Gadh O.P.) P.S.Case No. 78 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Arun Kumar, J) Sujit/- U
