Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 387, 307, 324/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the petitioner fired upon the brother of the informant, due to which he sustained injury in his leg. It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.5.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Vide Annexure 2 to the supplementary affidavit, a petition has been filed by the informant in the court below, where he has retracted from his

Patna High Court CR. MISC. No.57415 of 2019(2) dt.17-09-2019 2/2 earlier statement made in the F.I.R. The petitioner is alleged to have been made accused due to mistake of fact. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 14th Additional Sessions Judge, Rohtas at Sasaram in connection with S.Tr. No.352 of 2019 arising out of Sasaram Town P.S. case No.208 of 2019.
