JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kinjar P. S. Case No. 96 of 2017 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code and Section 3/4 of the Prevention of Damage to Property Act.

Petitioners are named in the first information report but no specific overt-act has been attributed against the petitioners. However, perusal of first information report goes to show that one

Patna High Court Cr.Misc. No.60532 of 2018 (2) dt.06-10-2018 2/2 person died in accident and petitioners as well as their supporters are said to have blocked the road and when police came there to remove the blockage, the mob became furious and damaged the government property.

Para 3 of the petition reveals that the petitioners do not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, above named, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Arwal in Kinjar P. S. Case No. 96 of 2017 subject to conditions as laid down under Section 438(2) of the Cr. P. C.
