The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Sections 3, 4 and 5 of the Explosive Substances Act.
The informant named the petitioner along with other accused persons and alleged that Pappu Sah was driving the motorcycle and an unknown person was sitting as a pillion rider threw bomb on the informant. Pappu Sah is alleged to have thrown bomb on Baijnath Yadav. It is alleged that the petitioner have conspired as he also threatened the informant to kill him before the occurrence.
Considering the facts aforesaid and the fact that there is
Patna High Court Cr.Misc. No.26679 of 2015 (2) dt.28-07-2015 2/2 no allegation against the petitioner that he threw bomb, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Chandan P.S. Case No. 43 of 2015.
