The petitioners are apprehending their arrest in connection with Bikramganj P.S.Case No. 126 of 2017 registered for the offence under Section 366A of the Indian Penal Code. Allegation against the petitioners is of kidnapping a minor girl of the informant.

Submission of learned counsel for the petitioners is that, as a matter of fact, the girl was in love with third son of petitioner No.1 and these petitioners have falsely been implicated in this case.

Heard learned APP and learned counsel for the informant, who have opposed the prayer for anticipatory bail stating that there was conspiracy of the petitioners in kidnapping the girl.

Having heard both sides and in view of the facts and

No.36543 of 2017 (2) dt.10-08-2017 2/2 circumstances, let petitioner No.1, being father of petitioner No.2 and other accused, above named, surrender within a period of four weeks before the court below and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Bikramganj P.S.Case No. 126 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of court concerned and he will co-operate in the investigation and will appear before the investigating officer as and when required, failing which his bail bond shall be cancelled.

So far petitioner No.2 is concerned, in the facts and circumstances, let him surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
