JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 26-06-2015 Learned counsel for the petitioner seeks permission to correct the prayer portion of the petition and the same is allowed.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

There happens to be specific allegation against the petitioner to have shot at the informant at the instigation of coaccused Suchit Sahni and Babu Saheb Sahni and on account thereof, instant case has been registered under Section 307 I.P.C. along with other allied Sections of the I.P.C. as well as Arms Act. However, taking into account his period of detention since 31.03.2014, a direction was given at an earlier occasion to renew his prayer, in case, trial is not concluded within six months vide order dated 03.11.2014 in Criminal Miscellaneous No28196

Patna High Court Cr.Misc. No.26732 of 2015 (02) dt.26-06-2015 of 2014. From the order annexed with the instant petition, it is evident that the case was committed on 26.03.2015 and from the impugned order dated 19.05.2014, there happens to be complete absence of the theme whether charge has been framed or not. That being so, petitioner, Luto Sahni is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Raj Kumar, learned Additional Sessions JudgeVIIth, Begusarai in connection with Sessions Trial No.158 of 2015/ 31 of 2015 arising out of Begusarai Mufassil P. S. Case no.310 of 2013. Furthermore, the District & Sessions Judge is expected to have proper attention towards the cases wherever there happens to be direction of the Superior Court, otherwise it will intricate the future action.
