ANJANA MISHRA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Bhagwanpur P.S. Case No.42 of 2016, corresponding to G.R. No.617 of 2016, registered for the offence under Sections 452, 341, 323, 324, 379, 307 and 504/34 of the Indian Penal Code.

Case diary in the present case was called for, which has since been received.

After hearing the learned counsel for the petitioners and the learned counsel for the State and after perusal of the case diary, it appears that the injuries purported to have been

Patna High Court Cr.Misc. No.19500 of 2016 (3) dt.28-07-2016 2/2 inflicted by the petitioners have been found to be simple in nature and that there is also a history of enmities as the present petitioners are own brothers and have been litigating over a piece of land.

Considering the facts and circumstances aforementioned, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction learned Sub-Divisional Judicial Magistrate, Bhabua, in connection with Bhagwanpur P.S. Case No.42 of 2016, corresponding to G.R. No.617 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
