ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Udwantnagar P.S. Case No.270 of 2018 for allegedly having committed the offences under Section 147, 148, 149, 341, 342, 323, 324, 504, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the entire case against the petitioner is frivolous and the only allegation, which has been attributed to him, is that of having been the part of the crowd and he is said to have been holding the rifle. It is further submitted that no overt act has been attributed to the petitioner and, therefore, he may be extended

Considering the aforementioned facts and circumstances and that the petitioner has no criminal history, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Udwantnagar P.S. Case No.270 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
