JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 The petitioners are apprehending their arrest in connection with Khagaria( Muffasil) P.S. Case No. 216 of 2015 for the offences instituted under Sections 147, 148, 149, 353, 152, 337, 338, 427, 307, 332, 511, 392 of the I.P.C. and 27 of the Arms Act. Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that the accused persons caused obstruction in discharging public duty, formed unlawful assembly, pelted stones on administrative officers, damaged the vehicles, lain on the road, caused blockade and made firing and further the female folks of Bharat Rai surrounded the
Patna High Court Cr.Misc. No.26694 of 2015 (2) dt.20-07-2015 2/2 police party and taking benefit Bharat Rai and his family members succeeded to flee away with fire arms.
It has been submitted on behalf of the petitioners that the petitioners are the ladies. It is further submitted that the petitioners have falsely been implicated in the present case due to village politics. It has further been submitted that other co-accused have been granted anticipatory bail vide Cr. Misc. No. 24134 of 2015. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Khagaria (Muffasil) P.S. Case No. 216/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
