The petitioner seeks bail in Chandauti P.S. Case No. 281/2013, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant, widow of the deceased, made allegation that the petitioner along with Sikandar Bhuian, Upendra Bhuian, Jatan Bhuian, Aditya Bhuian and Devlal Bhuian came to her house and brutally assaulted her husband and threw his dead body by the side of railway track.

It is submitted that the informant is not an eye-witness of the occurrence. The occurrence is said to have taken place at 10 PM but the FIR was lodged after recovery of the dead body. The informant did not inform other villagers. Similarly situated co-

Patna High Court Cr.Misc. No.31061 of 2015 (2) dt.17-08-2015 2/2 accused Upendra Bhuian, Sikandar Bhuian, Aditya Bhuian and Jatan Bhuian have already been enlarged on bail vide order passed in Cr. Misc. No. 157 of 2015. The case of the petitioner stands on the same footing.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No. 281/2013.
