Petitioner is not named in the first information report but in course of investigation, the name of petitioner surfaced in this case on the basis of location of his mobile. Furthermore, it also came to light that prior to the alleged occurrence, an altercation had taken place between the petitioner and the informant. Moreover, the aforesaid fact goes to show that petitioner was well known to the informant and his family members and if the petitioner had participated in the alleged crime, informant would have disclosed his name.
