Petitioner apprehends arrest in connection with Mahila P.S. Case No. 21 of 2022 registered for the offences under Sections 376 and 506/34 of the Indian Penal Code, 4/6 of POCSO Act and 3/4 of D.P. Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Further submission is that the First Information Report has been lodged after a delay of one month of the occurrence without there being any explanation regarding the same. It is also submitted that doctor determined the age of the victim (informant) to be 18 to 19 years as is evident from the medical report which is annexed at Annexure-2 to the bail
Patna High Court CR. MISC. No.62163 of 2022(2) dt.06-01-2023 2/2 petition. He also submits that petitioner has got no criminal antecedent.
Considering the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge (POCSO), Darbhanga in connection with Mahila P.S. Case No. 21 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
