Petitioner today filed supplementary affidavit and annexed the order dated 21.11.2017 passed in Jamabandi Cancellation Case No.38 of 2014-15 by the Additional Collector, Muzaffarpur whereby Additional Collector dropped Jamabandi Cancellation Case No.38 of 2014-15 in view of the pendency of Title Suit No.43 of 2014. The petitioner has also filed I.A. No.9368 of 2018 stating that the petitioner filed Jamabandi Cancellation Appeal No.1 of 2018-19 before the Collector, Muzaffarpur against the order dated 21.11.2017 by which the Additional Collector dropped the Jamabandi Cancellation proceeding and prayed that this writ petition be

Patna High Court CWJC No.7285 of 2016(2) dt.13-12-2018 2/2 disposed of with a direction to the Collector to dispose of the Jamabandi Cancellation Appeal No.1 of 2018-19. In this view of the fact that since Jamabandi Cancellation case has been dropped vide order dated 21.11.2017 and the petitioner filed appeal against that order, this writ petition has become infructuous. Accordingly, the same is dismissed as has become infructuous and the Collector is directed to dispose of the appeal of the petitioner preferably within four months from the date of receipt of this order.
