JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467, 468 of the Indian Penal Code.

As per the prosecution case, on secret information online shop of co-accused, Amit Kumar was raided, who disclosed the name of petitioner and his license Number and on the basis of license number physical verification of stock of sand was done and it was found that only 10,000 cft. sand is available whereas 29,750 cft. sand is displayed in the ID issued by the Mining department. It is alleged that fraudulently sell of sand and theft of Government revenue is done by this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.64924 of 2022(3) dt.17-03-2023 2/2 case. It is further submitted that without proper verification and measuring of stock it was concluded that only 10,000 cft. sand is available. Neither any copy of scanned challan or registration number of vehicle nor any name and address of customer is mentioned in F.I.R. The name of this petitioner has been dragged in connivance with license holders contractors of sand. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Bihta PS case No. 609/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
