====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Alamganj P.S. Case No. 142 of 2021 registered under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act. Learned counsel for the petitioner submits that petitioner is in custody since 05.03.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 50 Kg. of Gaanja from a Maruti Car which the petitioner was alleged to have been driving. Learned counsel submits that the petitioner has been falsely implicated in the present case, he is neither the owner nor the driver of the Maruti vehicle and if the petitioner was driving the vehicle then there is no seizure of the keys of the car.

Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.72002 of 2021(2) dt.12-05-2022 2/2 bail of the petitioner and submits that the alleged recovery is of commercial quantity of Gaanja.

Considering the submission made by the learned A.P.P., the court is not inclined to grant bail to the petitioner. (Satyavrat Verma, J) ved/- U T
