2. The petitioner seeks bail in connection with Excise P.S. Case No. 398 of 2025 registered for the offence punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the recovery is of 252.540 liters of illicit whisky.

4. The petitioner is in custody since 26.07.2025.

5. Considering the quantum of recovery, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.63666 of 2025(2) dt.23-09-2025 2/2 the learned Special Judge, Excise-II, Kishanganj /concerned Court below in connection with Excise P.S. Case No. 398 of 2025.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Musahari Police Station, District- Muzaffarpur on every Sunday of the month.
