Heard learned counsel for the informant and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Buxar Town P.S. Case No. 237 of 2015, disclosing offences under Sections 406 and 420/34 of the Indian Penal Code.

It is alleged that the petitioners had borrowed from the informant a Tata Summo Victa vehicle for its use in the marriage of the daughter of petitioner No. 1, who is the father of the petitioner no. 2. The vehicle was, thereafter, not returned. Subsequently, it came to light that the said vehicle was found

Patna High Court Cr.Misc. No.20373 of 2016 (3) dt.12-07-2016 2/2 being used for transportation of Ganja at West Bengal. Considering the gravity of offence, this application is, hereby, dismissed.

The petitioners, above-named, are directed to surrender before the court below within a period of four weeks from today and seek regular bail, if so advised. If they do so, their application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
