JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sonepur P.S. Case No. 422 of 2015, registered under Section 302 of the Indian Penal Code, pending in the Court of Sessions Judge, Saran at Chapra.

The accusation is that in course of quarreling this petitioner, who was in intoxicated state gave knife blow on Rahul Kumar, who was rushed to the referral hospital, but he died on the way.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. The petitioner is in custody since 03.11.2015. Learned counsel for the State vehemently opposed the

Patna High Court Cr.Misc. No.19620 of 2016 (2) dt.11-05-2016 2/2 prayer of the petitioner and submits that there is specific allegation against the petitioner to stab injury on the neck of deceased. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
