Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 161 of 2021 lodged under Sections 341, 324, 323, 307, 504, 354 and 379/34 of the Indian Penal Code.

As per prosecution, the informant has narrated that she was sitting with her husband at her house, in the meantime the named 6 persons reached there with weapon and started abusing. Upon query, the petitioner has assaulted on the head of the informant, in result the bleeding started. Learned counsel for the petitioner submits that the petitioner and informant both belong to the same village and next door neighbour and there is land dispute between both the family. Patna High Court CR. MISC. No.72381 of 2021(3) dt.18-10-2022 2/2 was an open fight took place between the informant side and the petitioner side. The case which was lodged by the petitioner's side is Annexure-2 series. Learned counsel further submits that injury are from both the sides, which he has placed by filing supplementary affidavit in this case. Learned counsel further submits that the petitioner is an old aged person of 62 years having clean antecedent and he is in custody since 04.10.2021. He further submits that charge sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Gopalganj in connection with Baikunthpur P.S. Case No. 161 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
