The petitioner apprehends his arrest in Belaganj P.S. Case No. 117/2015, registered for the offence punishable under Sections 147, 148, 149, 323, 307, 448, 379, 504 of the Indian Penal Code.

The informant alleged that the petitioner assaulted Nihaluddin with Pharsa on his head.

It is submitted that the doctor did not find any sharp cut injury on the head of the injured Nihaluddin, but from perusal of the injury report it appears that there is eccimoris at back of chest caused by hard and blunt substance and there is bleeding from his nose. The opinion with regard to injury is kept reserved. Considering the facts aforesaid, I am not inclined to
