JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-08-2017 Heard learned counsel for the petitioner and learned APP representing the State.
The petitioner apprehends his arrest in connection with Muzaffarpur Sadar P.S. Case No. 503 of 2016 registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471, 120b of the Indian Penal Code.
Allegedly, on the verification made by the petitioner compensation was paid to the beneficiaries in an illegal manner and the petitioner conspired with other co-accused in the said occurrence.
Submission is of false implication and that there is no specific allegation against the petitioner. In this case similarly situated other co-accused have been allowed pre-arrest bail by different co-ordinate Benches of this Court and as such the
Patna High Court Cr.Misc. No.35417 of 2017 (2) dt.11-08-2017 petitioner deserves sympathetic consideration. Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sadar P.S. Case No. 503 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
