Petitioner apprehends arrest in Keshariya Police Station Case No 156 of 2014 registered under Sections 420, 467, 468, 471 of Indian Penal Code.
Learned counsel for the petitioner submits that the allegation of holding the lands in question on the basis of a forged lease deed is predominantly civil in nature for which the informant has taken resort to the criminal proceedings on extraneous consideration. Considering the predominantly civil nature of dispute, prayer for anticipatory bail of co-accused Anil Singh, Ram Barai Thakur, Krishna Murati Singh and Shiv Mangal Singh has been allowed by a coordinate Bench of this
Patna High Court Cr.Misc. No.65577 of 2018(2) dt.13-12-2018 2/2 Court in Cr Misc No 16420 of 2018. The petitioner, at best, is allegedly a deed writer and has no concern with the alleged forged deed.
Considering the aforesaid circumstances, prayer for anticipatory bail is allowed. In the event of his arrest or surrender before the Court below within four weeks from today, the petitioner above named shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XI, East Champaran at Motihari in Keshariya Police Station Case No 156 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
