The petitioner seeks bail in a case registered under Sections 386, 341, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that on 10.10.2018 at 10.17 a.m. the informant received message of extortion on his mobile phone a a call was also made by mobile phone in the name of Lallu Khan.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.02.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on disclosure made by

Patna High Court CR. MISC. No.59980 of 2019(2) dt.23-09-2019 2/2 co-accused. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati (Gaya) in connection with Raushanganj (Bankey Bazar) P.S. case No.174 of 2018.
