The petitioner has prayed for bail in a case registered for the offence punishable under section 364 (A) of the Indian Penal Code and later on sections 302, 201, 120(B) of the IPC were added.

As per allegation in the FIR, son of the informant namely, Rohit Kumar (deceased) went away from his house and for demanding ransom amount of Rs. 45 lakh, a call was made by his son's mobile number to the mobile number of his daughter.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not

Patna High Court CR. MISC. No.61572 of 2022(3) dt.28-03-2023 2/2 named in the FIR. During investigation, his name appeared in confessional statement of co-accused Priyam Kumar. Save and except confessional statement, nothing has come against the petitioner to show his involvement in the present case. Similarly situated other accused person has already been enlarged on bail by this Court vide order dated 16.01.2023 passed in Cr. Misc. No. 45428 of 2022. Petitioner is languishing in judicial custody since 15.04.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 1st, Naugachia in connection with Bihpur P.S. Case No. 168 of 2022.
