Patna High Court Cr.Misc. No.25553 of 2014 (3) dt.13-01-2015 2/3 Case No. 32 of 2014 registered under Sections-392 & 411 of the Indian Penal Code and accordingly, these petitions are being heard and disposed off by this common order.
Heard learned counsels for the petitioners and learned counsel, appearing for the State.
Petitioners are named in the first information report with specific allegation that they committed road robbery and while they were fleeing from the place of occurrence, they were caught by the police and the informant claimed to have identified the petitioners.
According to first information report, the alleged occurrence took place at 1.30 a.m. whereas; the seizure list in connection with Ishakchak P.S. Case No. 07 of 2014 was prepared at 4.00 a.m. whereas; the first information report of the aforesaid case reveals that petitioners were caught at about 3.30 a.m. The contention on behalf of the petitioners is that as a matter of fact, an altercation had taken place between the informant and the petitioners on the point of parking of the vehicle and the informant, having managed the police officials, lodged the present case and moreover, petitioners are in jail custody since 2801-2014 and except the present case as well as Ishakchak P.S. Case No. 07 of 2014, there is no any other criminal antecedent of
Patna High Court Cr.Misc. No.25553 of 2014 (3) dt.13-01-2015 3/3 the petitioners.
Considering the aforesaid facts and circumstances as well as submission of the parties as also keeping in mind the period of detention of the petitioners in jail custody, let the petitioners, named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Kotwali P.S. Case No. 32 of 2014 to the satisfaction of Chief Judicial Magistrate, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
