JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302 and 324/34 of the Indian Penal Code. The allegation against the petitioner and others is that they have committed brutal murder of the husband of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that there is no direct or indirect evidence against the petitioner. The name of the petitioner has come only on suspicion. Other coaccused has been granted anticipatory bail vide order dated 20.05.2015 in Cr. Misc. No.33739 of 2014.

On behalf of the State, it has been submitted that

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikarahana at Motihari, East Champaran in connection with Rajepur P.S.Case No. 110 of 2012, subject to the conditions as laid down u/s 438(2) Cr.P.C.
