JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Minapur P.S. Case No. 230 of 2018 registered for the offences punishable under Sections 304-B, 201/34 of the Indian Penal Code.

Petitioner no. 1 is married Nanad, petitioner no. 2 is Gotini, petitioner no. 3 is Devar and petitioner nos. 4 and 5 are co-villagers of the deceased.

No.66199 of 2018(2) dt.17-12-2018 2/2 No doubt, the postmortem report reveals that the deceased died due to asphyxia as a result of anti mortem pressure on her neck but considering this aspect of the matter that no specific overt-act has been attributed against the petitioners and submission on behalf of the petitioner nos. 2 and 3 is that they reside separately from the husband of the deceased, it is ordered that petitioners, above named, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in Minapur P.S. Case No. 230 of 2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
