The petitioner is accused in connection with Phulwarisharif P.S. Case No. 293 of 2015, registered under Section 366(A), 363, 376/34 of the Indian Penal Code and Section 4/6 of the POCSO Act.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that Gajendra Pandey, maternal uncle of the victim, lodged this case against Rajesh Kumar Pandey regarding the kidnapping of his niece. In course of investigation, the victim was recovered, when petitioner came to know about kidnapping of the victim by his son, he took the victim at Helpline from where father of the victim brought her
Patna High Court Cr.Misc. No.19689 of 2016 (2) dt.11-05-2016 2/2 home. The statement of victim under Section 164 of Cr.P.C. was recorded in which she has only stated about performing her marriage with Rajesh Kumar Pandey in presence of the petitioner and other family members. Further submission is that petitioner is in custody since 23.01.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge-cum-Special Judge, Patna in connection with Spl. Case No. 33 of 2016 arising out of Phulwarisharif P.S. Case No. 293 of 2015.
