Heard the parties.

This application has been filed for modification of the order dated 24.11.2021 passed in Cr. Misc. No. 17690 of 2021. It is submitted by learned counsel for the petitioner that though the petitioner was granted anticipatory bail, during the pendency of the anticipatory bail application supplementary charge sheet has been submitted and some more sections of the Indian Penal Code were added which were not mentioned in the FIR and therefore, the court below has not accepted his bail

It is the duty of the litigant and his lawyer to inform the Court at the time of final hearing of any bail application as to what was the present status of the case and the petitioner has failed to do so.

In that view of the matter, this modification application is not maintainable and it is dismissed. However, the petitioner is given liberty to take appropriate step by filing a fresh anticipatory bail application. (Sandeep Kumar, J) BT/- U T
