2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 103 (1) , 61 ( 2 ) (a) and 3 (5) of Bns and section 27 of Arms Act.
3 . As per F.I.R. on 17.06.2025 atabout 11:30 PM, the husband of informant was returning home after participating in a Shradh ceremony , this petitioner along with other co-accused persons and 5 - 7 unknown fired indiscriminately on husband of informant and one Chandan Kumar, due to which, both of them died on spot.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.69568 of 2025(3) dt.12-02-2026 2/2 specific accusation is against other co-accused persons. As per F.I.R. this petitioner is only alleged to be conspirator and he is not alleged to have participated in the alleged occurrence or present at the place of occurrence .
5 . Learned counsel for the State as well as informant vehemently opposed the bail petition .
6 Considering the aforesaid facts, materials available on record and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Lakhisarai in connection with Pipariya P.S. Case No. 60 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
