JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel for the informant.

The petitioner in the present case is seeking regular bail in connection with Muffasil P.S. Case No. 761/2018 registered under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act, pending in the court of learned C.J.M., Begusarai.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case and there is no source of identification given by the informant to show that this petitioner is involved in the alleged offence, however he is in custody since 26.06.2019.

Patna High Court CR. MISC. No.59712 of 2019(3) dt.27-11-2019 2/2 Learned A.P.P. for the State has opposed the prayer for bail submits that there are specific allegations of firing against this petitioner and the post-mortem report also supports the prosecution story that the three persons had fired on the deceased including this petitioner.

Considering the facts and circumstances of the case wherein it is found from the materials on the record that there are specific allegations of firing against this petitioner and the post-mortem report also supports the prosecution story that the three persons had fired on the deceased including this petitioner and the prayer for regular bail of the similarly situated accused Bambam Singh has been rejected by a learned coordinate Bench of this court vide order dated 20.11.2019 passed in Cr. Misc. No. 49035/2019, the prayer for bail of this petitioner is also rejected. The learned Coordinate Bench has already directed the learned Sessions Judge/Trial Court to expedite the trial. Let it be done.
