The petitioner apprehends his arrest in a case under Section 386 of the Indian Penal Code and Sections 3 / 4 of the Explosive Substance Act.

The informant made allegation that on his mobile, a call was made from Mobile No. 9504706006 and ransom of rupees two lakhs was demanded. Learned counsel for the petitioner submits that of course, the aforesaid mobile belongs to the petitioner but he did not make any call. He is a government servant. The other accused persons have already been enlarged on regular bail. One Bablu Dubey disclosed that he made a call to the informant.

Considering the facts aforesaid and the nature of allegations made against the petitioner, I am not inclined to

Patna High Court Cr.Misc. No.27816 of 2015 (2) dt.22-07-2015 2/2 enlarge the petitioner on anticipatory bail in Chakia P.S. Case No. 41 of 2010. Accordingly, the same is rejected. The petitioner, if so advised, may surrender in the court below and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner taking into consideration the fact that other accused persons have already been enlarged on regular bail.
