JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Barun P.S. Case No. 35 of 2017 registered for the offence punishable under sections 420, 379, 411, 120B of the Indian Penal Code, sections 3, 4 and 5 of the Bihar Illegal Mining Act and sections 33, 41 and 42 of the Indian Forest Act.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been made accused in the present case merely because he is the owner of the vehicle in question. Similarly situated co-accused has been granted bail by this Court vide order dated 13.07.2017 passed in Cr. Misc. No. 30009 of 2017. Petitioner has no criminal antecedent.

No.35304 of 2017(3) dt.08-09-2017 2/2 Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 35 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
