This application for grant of regular bail arises out of Lodipur P.S. Case No.230 of 2020 (Special POCSO Case No. 42 of 2023) registered for the offence punishable under Sections 366/34 of the Indian Penal Code and under Section 8 of the POCSO Act but cognizance has been taken under Section 363, 366-A of the Indian Penal Code and under Section 8 of the POCSO Act.

Allegation against the petitioner is that he has kidnapped the daughter of the informant.

The alleged victim girl in her statement recorded under Section 164 of the Cr.P.C. has stated that she got married with the petitioner and thereafter they were staying in

Patna High Court CR. MISC. No.64292 of 2023(2) dt.11-10-2023 2/2 Delhi. The petitioner is in custody since 04.03.2023. 5.

Considering the aforesaid facts, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, VI-cum- Exclusive Special Judge, POCSO, Bhagalpur, in connection with Lodipur P.S. Case No.230 of 2020 (Special POCSO Case No. 42 of 2023).
