2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.
3. As per allegation in the FIR, the informant is engaged as Manager in Bharat Finance Ltd. Bagha and on 24.11.2020, while he and his co-worker were returning by a motorcycle after collecting money of Rs. 1,53,525/-, near Dhobaha Pool, two miscreants on a motorcycle overtook them and looted the entire amount, mobile phone and bio-metric machine.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither
Patna High Court CR. MISC. No.69132 of 2024(2) dt.07-10-2024 2/2 the petitioner is named in the FIR not put on TIP. There is no eye witness of the alleged occurrence. Nothing has been recovered from his conscious possession. Similarly situated other co-accused person, namely, Rajan Chaudhary has already been granted bail by this Court vide order dated 13.03.2023 passed in Cr. Misc. No. 46330 of 2022. Petitioner is languishing in judicial custody since 17.07.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Bagaha, West Champaran in connection with Valmikinagar P.S. Case No. 61 of 2020 subject to the condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court.
