This application, for grant of anticipatory bail, arises out of Complaint Case No.380 of 2014, disclosing offences under Section 304(B) of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that falsity of prosecution case is writ large and is apparent

Patna High Court Cr.Misc. No.28656 of 2015 (4) dt.03-02-2016 2/2 from the report submitted by the police officer, pursuant to an order of learned Chief Judicial Magistrate, which has been brought on the record by way of Annexure-4 to this application.

However, since this application for anticipatory bail arises out of complaint case, the petitioner is directed to surrender before the court below within a period of four weeks from today and apply for regular bail, if so advised. If he does so, the learned court below shall consider his case in the light of this Court's decision, in case of "Salim Ansari @ Md. Salim Vs. The State of Bihar & Anr." [2015(3) PLJR 807], and decide the said application on the same day.
