The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406, 420, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is owner of the truck which had been hired by the informant for transporting rice from his shop. However, the driver of the truck disappeared along with the aforementioned quantity of rice and subsequently, the same has been recovered from the house of the maternal uncle of the said truck driver.
Considering aforementioned facts and circumstances and also the fact that the petitioner is the owner of a transport agency
Patna High Court Cr.Misc. No.31723 of 2015 (2) dt.14-08-2015 P2/2 known as 'Tiwari Transport Agency' and has a good reputation with no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 636/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
