JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Excise P.S. Case No. 149 of 2018 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Three litres of country made foreign liquor is said to have been recovered from a place which is stated to be meant for keeping fodder for cattle.

The learned counsel for the petitioner has submitted that the place from where recovery has been made does not belong to the petitioner.

Regard being had to the aforesaid facts as also

Patna High Court Cr.Misc. No.66498 of 2018(2) dt.14-12-2018 2/2 taking into account that petitioner does not have any criminal antecedents, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Excise P.S. Case No. 149 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
