JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 399, 402, 414 of the Indian Penal Code and 25(1b)a,26,35 Arms Act. Accusation is that on receiving secret information about committing the crime by some persons, the police reached there and on seeing the police party, they started fleeing away but on chase this petitioner and one another person were apprehended and they disclosed their names as Bablu Kumar and Nitish Kumar. On search one country made pistol was recovered from the possession of the petitioner.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.19692 of 2016 (2) dt.11-05-2016 2/2 petitioner submits that the petitioner has falsely been implicated in the present case merely on suspicion and is in custody since 24.11.2015.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., at Biharsharif, District- Nalanda in connection with Noor Sarai P.S.Case No. 330 of 2015. Out of two bailors, one bailor must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
