JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-08-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. Earlier the prayer for bail of the petitioners was rejected by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 67342 of 2019.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 308, 379, 504 and 506/34 of the Indian Penal Code. It is a case of assault upon the husband of the informant by the petitioners with fist and slaps due to which he suffered grievous injury of loss of teeth of her husband as well as they snatched gold chain of the informant.

Patna High Court CR. MISC. No.500 of 2022(3) dt.23-08-2022 2/2 It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the husband of the informant caused an injury of breaking of teeth but the doctor has found no injury on teeth and it is stated to be simple in nature. He further submits that good sense has prevailed between the parties. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.K. Raj, Judicial Magistrate, Ist Class, Jamui/concerned Court in connection with Laxmipur (Gidhaur) P.S. Case No. 309 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
