The petitioners seek pre-arrest bail in connection with Kurtha P.S.Case No. 174 of 2016 registered under Sections 341, 379, 420, 427/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the co-accused Sunil Kumar, Anant Kumar and Bhimlesh Kumar @ Bimlesh Kumar @Nimlesh Kumar @ Minlaish Kumar having more or less identical allegation to that of the petitioners have already been granted the privilege of prearrest bail by a coordinate Bench of this Court vide order dated 28.03.2017 passed in Cr.Misc. No. 10917 of 2017.
Patna High Court Cr.Misc. No.41893 of 2017 (2) dt.21-09-2017 2/2 Considering the nature of allegation and the aforesaid order dated 28.03.2017, as contained in Annexured-2 to the present application, in the event of arrest or surrender before the court below within four weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S.Case No. 174 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
