However, after going through the pleadings, I find that the petitioner claims the pecuniary benefits arising out of the 2nd (Modified Assured Career Progression) M.A.C.P. in terms of Resolution dated 12th July, 2010.

Learned counsel submits that he was appointed as a Project Manager in the Industries Department and that no proceedings have ever been undertaken against the petitioner.

Patna High Court CWJC No.18604 of 2019 dt.09-09-2019 2/2 It has also been further alleged that juniors to the petitioner, namely, Shri Sanjay and Mukesh, who have their rank at 57 and 58, have been extended the said benefit whereas the petitioner having Rank 52 has not been extended the benefit. A report has been filed before the Accountant General on 15th of May, 2019.

This writ petition is, therefore, disposed of with a direction to the authority to examine the claim of the petitioner on merits and pass an appropriate order in accordance with law expeditiously, preferably within three months from the date of receipt/production of a certified copy of this order.
